Welcome to My Family Story Vault ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of the My Family Story Vault website located at https://myfamilystoryvault.com (the "Service") operated by My Family Story Vault LLC.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
1. Description of Service
My Family Story Vault is a digital archive platform that allows users to create and maintain tribute pages for their loved ones, including family stories, media uploads, timelines, and family trees that can be passed down through generations.
2. User Accounts and Subscription
2.1 Paid Users (Owners): By subscribing to a plan, you become a paid user and the Owner of the Honoree profiles you create, with access to create tribute pages, upload media, add stories, create timelines and family trees, invite others to participate, manage permissions, and export all Honoree media.
2.2 Authenticated Users: Users invited by an Owner receive access based on assigned permission levels:
- Gatekeepers: Can invite other users as Contributors or Viewers, manage permissions, upload media and add content to tribute pages, timelines and family trees, and export all Honoree media
- Contributors: Can invite other users as Viewers, upload media, add content to tribute pages, timelines and family trees, and export all Honoree media
- Viewers: Can view tribute pages
2.3 All authenticated users may upgrade to a paid account to create their own tribute pages, becoming the Owner of those Honoree profiles.
2.4 Tribute Lite: We also offer Tribute Lite, a one-time $99 purchase (not a subscription) granting one tribute page for a 1-year term, including up to 500GB of storage. Tribute Lite does not include private stories or the ability to invite Contributors. It may be purchased as a gift for another person.
3. Ownership and Content
3.1 Paid users own the tribute pages they create and all content uploaded to those pages.
3.2 You retain ownership of any content you submit, post or display on or through the Service.
3.3 You are responsible for the content you upload and must ensure you have the right to use and share such content.
4. Data Collection and Privacy
4.1 We collect the following personal data: name, email address, profile image (optional) and payment information.
4.2 We use Umami analytics for privacy-focused website analytics, which collects non-personal, aggregated data about website usage without tracking individual users or storing personal information.
4.3 Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.
5. User Responsibilities
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.
- You may not upload content that is harmful, offensive, or violates the rights of others.
6. Payment and Billing
6.1 Paid services require advance payment of applicable fees.
6.2 All fees are non-refundable except as required by law.
6.3 We reserve the right to modify pricing with advance notice to users.
6.4 Tribute Lite is a one-time, non-recurring purchase and does not automatically renew or auto-charge at the end of its 1-year term. To continue access after the term ends, you may repurchase Tribute Lite for an additional 1-year term. You may upgrade from Tribute Lite to a subscription plan at any time; an active subscription cannot be downgraded to Tribute Lite.
7. Termination
7.1 You may cancel your subscription at any time by contacting us at support@myfamilystoryvault.com or by accessing the 'Manage Billing' section in your dashboard.
7.2 You may upgrade or downgrade to a different subscription plan at any time.
7.3 If you cancel your subscription, or your Tribute Lite term ends without renewal, your loved one's story will remain online and accessible until the end of your current subscription period or Tribute Lite term. After that time, you, and all invited users, will lose access to your loved one's story and all associated content.
7.4 Upon subscription cancellation, tribute pages scheduled for deletion can be re-activated by a user with Gatekeeper or Contributor permission level if they activate a subscription plan and indicate they want to take-over the Honoree profile that was disabled.
7.5 Account subscribers can download an export of all media content from their Media Library.
7.6 We may terminate or suspend your account immediately if you breach these Terms.
7.7 Upon termination by us for cause, your right to use the Service will cease immediately.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
